Terms & Conditions

The terms and conditions contained on this page shall apply to all orders we receive. These can only be varied if we (Exmoor Teddy Bears) expressly agree in writing in which the extent of any variation will be clearly stated. By placing an order you, the customer, are agreeing to all points and no variation can or will be accepted by us.

How to Order

To buy an item you must first add it to your shopping basket, to do this simply click on the "Add to Basket" button alongside the item you wish to buy. If the item has options available (e.g. height) you should select your desired option before clicking on the button. If you require a quantity other than 1 you should also enter this before clicking on the button.

Your shopping basket is displayed each time you add an item or can be displayed at any time by clicking on the "Your Basket" link. To remove an item from your basket simply enter a quantity of 0 and click on the "Update Basket" button.

Your basket also displays the delivery charge associated with your order and allows you to select the delivery option you require.

If you are logged in as a member of our Gold Club the discount applicable to your order will be displayed in the basket.

Once you have added all of the items you wish to purchase to your basket you should proceed to our secure checkout by clicking on the "Proceed to Checkout" button within your basket or by clicking on the "Checkout" link.

You must now decide how you will pay for your order. Secure on-line payment by credit or debit card is available via RBS WorldPay or PayPal, alternative methods are available for those who do not have a credit or debit card or who do not wish to pay on-line. From this point on simply follow the on-screen instructions associated with each payment method.

Prices

All prices are quoted in pounds sterling and include value added tax (VAT) applicable to United Kingdom sales. We are VAT registered in the United Kingdom under reference number 901 2067 74.

We will not accept any liability for any charges levied by your bank/card issuer whatsoever irrespective of your chosen payment method.

We aim to never knowingly be beaten on price. If you find the same (new and in perfect condition) item offered within the United Kingdom for sale by a retailer and not a private individual or manufacturer within 7 days of placing your order we will refund 110% of the difference. If this situation arises then please e-mail the details to us for verification. Prices used as a comparison must be published in the public domain e.g. web site or mail order catalogue and not verbally given. The item must be available from stock at the present time and not an item to order or previously sold out. Please note this excludes items offered for sale from outside the United Kingdom, in any other currency except pounds sterling, items which are offered as part of a sale or promotion or at a discount for certain categories of customer, auction items or items where the price is reached by mutual agreement and not fixed. This also excludes items which do not have United Kingdom VAT applied to them. Postage costs are excluded and this price promise applies to the goods themselves only.

Delivery

We aim to ship all orders within 7 working days of receiving your payment (cleared funds). If we cannot, we will attempt to contact you and give you the option to cancel your order.

Please be aware that items offered for sale on this web site may only be available in very small quantities or be unique and there is always a possibility that at the time you place your order they have been sold by other means (in store, mail order) and are no longer available. We will make every effort to keep this web site as accurate and up to date as possible and you will be notified if this situation arises as soon as possible. We will of course refund any monies paid by you or you may choose an alternative item.

Delivery Charges - United Kingdom

FREE delivery by Standard Class/Parcel Post on orders over £100 otherwise £1.95 per order, or Special Delivery for a charge of £6.95. Please note we may at our discretion use 1st/2nd class or parcel post for orders where special delivery has not been paid.

Delivery Charges - Europe

£9.95 for orders up to £150 and FREE for orders above that amount.

Delivery Charges - Rest of World

£24.95 for orders up to £250 and FREE for orders above that amount.

The shopping basket automatically calculates and displays the amount of postage you will pay each time you add an item to it.

Please contact us if you wish us to arrange a special postal method.

Where more than one item is ordered at the same time we will aim to ship all items in the same package. Where this is impractical due to item size or weight then we may dispatch separately. This arrangement does not affect the postage charges shown. This could mean that individual items arrive with you at different times.

All overseas customers are responsible for any taxes, duties or other charges which are levied by customs authorities.

Returns & Complaints

We hope that you will be happy with your purchases, however you may return goods in their original condition and packaging within 7 days of delivery and we will either exchange them or refund you. For your own protection, you should ensure the goods are adequately insured while in transit.

Any claim from you in respect of goods not received or damaged in transit must be made in writing to us by post, fax or e-mail not later than 7 days (14 days for orders outside the United Kingdom) from the date we confirm items have been dispatched to you. Once this limit has been reached then all liability for goods not received or damaged in transit passes direct to you the customer and we will not accept any liability for such claims.

Ownership of any incorrect goods sent remains ours and upon receiving your notification we will advise you of return instructions.

Safety

Goods supplied meet safety regulations which govern their production and any exclusions or intended restrictions will be shown on labels attached to goods. Please note that goods are not manufactured by us and you should be aware of the manufacturer at the time of placing the order via our web site.

As with any type of product particular care should be exercised when giving them to children. In particular observe any age restrictions stated on labels and ensure all tags/labels and attachments are removed before giving to a child. Collector bears in particular are rarely suitable as young children’s toys and should not be purchased as such.

Additional Conditions

All correspondence will be conducted in the English language only.

The contract for sale between us and you, the customer, will be construed in accordance with and governed by English law and subject to the exclusive jurisdiction of the English Courts.

Ownership of any goods ordered will remain with us until payment has been made in full by you the customer. The term payment in full refers to cleared funds only.

If any parts of these terms and conditions have been abused by you in any way whatsoever then your order is void unless expressly agreed in writing by us to the contrary. Any monies paid by you to us will be refunded in full once funds have been cleared.

Security

All details transmitted between your browser and the server are SSL encrypted to guard against their interception by unauthorised persons.

Secure on-line payment is available via RBS WorldPay or PayPal.

Gold Club Terms & Conditions

  1. Only one application per person. Free membership is only by qualifying or invitation. To qualify you must spend £99 or over in one transaction on no more than four items and anticipate being a repeat customer.
  2. Gold Club memberships can also be purchased if a prospective member does not meet the criteria stated above. Membership costs £9.99 as a once only payment, renewal is free as long as the spend criteria stated below has been met.
  3. Applicants must be minimum 18 years of age and UK resident.
  4. Card valid until 31st July 2012.
  5. Card must be presented to gain discount in store, if buying via our website then Gold Club members must sign in to the Gold Club secure area on the site to have discount applied. If ordering by post or by telephone, please quote your Gold Club membership number.
  6. Spend level will be tracked when using the card and to qualify for renewal on 1st Aug 2012 the following applies.
  1. Members whose cards were renewed on 1st August 2009 must spend £400 or over by 31st July 2012 to have their membership renewed.
  2. Members who join between 1st August 2009 and 31st July 2010 must spend £300 using their card by 31st July 2012 to qualify for renewal.
  3. Members who join between 1st August 2010 and 31st July 2012 will have their cards renewed irrespective of spend level.
  1. Customers pledge to advise us should any of their details change.
  2. Customers who have purchased a Gold Club membership for £9.99 please note that this fee is non refundable in any circumstances.
  3. No minimum transaction value applies once a card has been issued.
  4. There is no obligation to use the card once issued. Renewal however is dependant upon the spend level during the valid period as stipulated above.
  5. The card is not a credit card or cheque guarantee card and carries no redemption value.
  6. Lost or stolen cards must be notified to us by telephone (01643 702333).
  7. The Gold Card may be used in conjunction with any special offer, discount or promotion offered either in store or online, unless expressly specified otherwise by Exmoor Teddy Bears either in store or online.
  8. Exmoor Teddy Bears reserve the right to cancel any individual card without notice or withhold cards presented in store at their discretion. Any Gold Club member who uses the layaway scheme and defaults will have their membership revoked at the time of default.
  9. The Gold club may be amended or withdrawn at any time and all members notified if either of these situations arise.
  10. Data held by Exmoor Teddy Bears will be kept in accordance with the Data Protection Act 1998 and adhere to the eight data protection principles.
  11. By joining the Gold Club, members are consenting to us contacting them by e-mail, phone or in writing to advise of any special offers/events or for other related reasons. Members can opt out of such contact and still remain a Gold Club member. Please notify us if you wish to receive no mailings from us.
  12. Exmoor Teddy Bears pledges it will not share data about either the club or its members with any third party other than any partner company involved in club administration only.
  13. We are happy to notify any member upon request of their spend level.
  14. Exmoor Teddy Bears may also issue Gold Club cards at the discretion of the proprietor or buyer.
  15. In the event of Exmoor Teddy Bears ceasing trading, the Gold Club may be sold as part of any asset sale.

Gold Club Members receive a 10% discount off virtually everything we sell*

* The only exceptions at the current time are:

  • Steiff or Bad Taste Bear Membership fees either for new memberships or renewals;
  • Club items for Steiff, Hermann Teddy Original, Bad Taste Bears or any other supplier that may offer club pieces;
  • Any personalised bears;
  • Any Charity Bears;
  • Items from the 'bargain basket' in store;
  • Any other items which expressly state no Gold Club discount either in store or on-line which may be offered from time to time.

Exmoor Teddy Bears may amend the discount level or change the terms and conditions at any time and will notify all Gold Club members if a significant change occurs as soon as is practical.
